1. Introduction
1.1 These Terms and Conditions govern (a) Your participation (subject to acceptance of your Submission by Babel) in the Weezer mash up competition (the "Weezer mash up competition") which is currently inviting submissions through the Babelgum service (the “Service”) and (b) the hosting on the Service and distribution via the Internet (accessible by any and all fixed and/or mobile viewing devices and applications) of all audio-visual content and related material You may upload as a submission for inclusion in the Weezer mash up competition.
1.2 Each individual item of audiovisual content uploaded by You using the upload service (including all metadata, credits and copyright notices) as a submission for inclusion in the Weezer mash up competition is referred to in these Terms and Conditions as a "Submission".
1.3 In order to consolidate a Submission to be considered for entry into the Weezer mash up competition, You must also agree to the Terms and Conditions of the Movie Masher service and the Babelgum Service at terms of service.
2. Submissions and Selection and Eligibility Criteria
2.1 The decision on whether or not to accept a Submission as an entry (“Entry”) into the Weezer mash up competition lies solely with Babel, who may reject or accept a Submission in its sole discretion.
o You must complete all compulsory fields in the Submission Form that accompanies Your Submission;
o Your Submission must be in the English language or have English language subtitles;
o Your Submission must not contain any material which in the sole opinion of Babel is pornographic or obscene;
o Your Submission must not include musical works and/or recordings other than the Weezer recordings supplied by Weezer without written consent and clearance from the owners and contributors of the same.
o You must not place or purport to place any geographical limitations on Babel's distribution of Your Submission;
o You must not be an employee of Babel or any other person or entity connected with the creation and administration of the Weezer Mash up Competition, or in any such employee's immediate family; and
2.2 Babel reserves the right to remove a video from the competition if considered offensive and solely at Babelgum discretion.
2.3 The video is submitted to the competition once it has been exported and viewable outside the movie masher editor.
2.4 There is no limit to the number of Submissions you can make to the Weezer mash up competition although there is no guarantee that any Submission will be accepted by Babel.
2.5 US RESIDENTS ONLY ARE ELIGIBLE TO ENTER AND WIN THIS PRIZE.
2.5 If any Submission does not meet the Eligibility Criteria or is otherwise not accepted by Babel for entry into the Weezer mash up competition, Babel may still choose to make use of the Submission but that Submission will not be entered into the Weezer mash up competition.
2.7 Babel may require You at any time (before or after your Submission has been accepted as a Weezer mash up competition Entry) on request to provide evidence to verify to Babel's reasonable satisfaction that the information You provided in the Submission Form is true and/or that You or Your Submission meets any relevant Eligibility Criteria. If, following a request, you fail to provide evidence of such matters which is satisfactory to Babel, we reserve the right to disqualify Your Submission and/or remove Your Submission from the Service.
3. Weezer Mash Up Competition
3.1 THE COMPETITION – RE-CREATE THE MOST INTERESTING MASH-UP FROM THE SUPPLIED WEEZER VIDEO CLIPS (THE “WEEZER CONTENT”) VIA THE VIDEO MASH-UP TOOL. THE BAND, WEEZER, WILL SELECT THEIR FAVOURITE CLIP OUT OF THOSE MOST VIEWED ON THE BABELGUM PLATFORM. JUDGING WILL TAKE PLACE BETWEEN NOVEMBER 26 AND 30.
3.2 We reserve the right at our discretion to extend the Submission Period and any such extension shall be specified via the Babelgum service.
3.3 You will be able to view the status of Your Submission at anytime by logging in to your Babelgum account. If Your Submission has not been successful Babel will contact you by email and advise how to resolve the issue. Your Submission will cease to be an Entry if you are subsequently disqualified in accordance with these Terms and Conditions.
3.4 Weezer mash up competition Entry will be displayed within an area of the Service dedicated to the Weezer mash up competition gallery from the technological time required to process the video and shall continue until the end of the competition period.
4. Awards
4.1 The best video chosen by the band Weezer will win one prize package in which one winner will be invited to spend the day with Weezer as Babelgum’s behind the scenes film-maker/reporter. Babelgum will choose and pay for one winner to receive economy class return travel, to and from a location, to be confirmed, within the United States of America.
The Weezer mash up competition is open to and the prize will be delivered to USA residents only. No cash prize alternative will be offered.
4.11 Prizes: Babel will announce the winner (the “Winner”) by means of the Service by the closing date of the comeotition as announced on the Babelgum Service (or an alternative date to be advised on the Service). Babel will contact the Winner by e-mail to advise them they have won. Babel also reserves the right in its sole discretion to make any reasonable changes to the Weezer mash up competition at any time and will also announce any changes via the Service. Babel’s decision in respect of the foregoing will be final.
5. Use of Content
5.1 You acknoledge that the Weezer Content provided for the Weezer mash up competition is owned and /or controlled by Weezer and/or Babel on behalf of Weezer and that all copyright and related rights in the Weezer Content and any variations or modifications of the Weezer Content shall vest in Weezer as the owner of the same. You acknowledge that no copyrights, moral rights or any other rights whatsoever will vest in you with respect to the Submissions.
In addition Babel shall have the right:
(a) to include and make available Your Submission as part of the Service and in any and all media in perpetuity
(b) to promote Your Submission and make it available for viewing in an area of the Service dedicated to the Weezer mash up competition; and
(c) to distribute (and authorise others to distribute all or any part of Your Submission in any and all media including without limitation in each case without any encryption, geo-blocking or other conditional access technology over the Internet by any means and via embedding on other websites and/or as a "viral" video and/or via other internet connected devices in perpetuity.
5.2 You expressly acknowledge and agree that Babel has no direct control over any distribution of all or part of Your Submission following its initial release onto the Internet in unencrypted form (whether as a viral video via embedding or otherwise). You agree that Babel shall have no liability to You whatsoever in relation to viral distribution of all or any part of Your Submission via embedding or otherwise by third parties at any time.
5.3 Babel may (at its discretion) make available any Submission on the Service even if:
o that Submission is not accepted as an Entry;
o the Weezer mash up competition is cancelled for any reason; or
o You are disqualified from the Weezer mash up competition.
6. Publicity
You agree to take part in reasonable Weezer mash up competition publicity (during the Weezer mash up competition Period and thereafter) requested by Babel and agree that You may be filmed, photographed or otherwise recorded by Babel or other third parties for this purpose. You agree that Your name, image, likeness, voice and statements may be published throughout the world in any medium now known or in the future devised in connection with your participation in the Weezer mash up competition and/or in the exercise of the advertising, publicity and marketing rights granted to Babel pursuant to these Terms and Conditions.
